These Terms of Service ("Terms") govern your access to and use of the iCare4Pune web application and related services (the "Service") provided by iCare4Pune ("iCare4Pune," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you use the Service on behalf of a business, you represent that you have authority to bind that business.

iCare4Pune provides a workspace for small businesses to manage leads, customers, communications (including SMS and email), applications, and related operations. We may add, change, or remove features over time. We do not guarantee uninterrupted availability and may suspend the Service for maintenance, security, or legal reasons.

• You must provide accurate, current information when registering and keep it updated.
• You are responsible for safeguarding your credentials and for all activity under your account.
• Notify us promptly of any unauthorized use. We are not liable for losses caused by compromised credentials.
• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

You agree not to:

• Violate any applicable law, regulation, or third-party right.
• Send spam, unsolicited marketing, or messages to recipients without required consent.
• Upload or transmit malware, or attempt to probe, disrupt, or reverse engineer the Service.
• Misrepresent your identity or the origin of any content.
• Infringe intellectual-property or privacy rights of others.
• Use the Service to process data you have no right to process.

We may suspend or terminate accounts that violate these rules.

You are solely responsible for ensuring your communications comply with applicable laws and carrier rules, including the Telephone Consumer Protection Act (TCPA), CTIA guidelines, CAN-SPAM, and similar regulations. This includes obtaining prior express consent before sending marketing texts, honoring opt-outs (e.g., STOP) promptly, and including required disclosures.

We may block or throttle messages that violate these requirements or create deliverability risk.

By providing your phone number and opting into our text messaging program, you consent to receive a one-time transactional security code on your mobile device. Standard message and data rates may apply. For assistance, reply HELP to the number from which you received the message, or contact us at admin@tamhan.com. To stop receiving messages, reply STOP at any time. Carriers are not liable for delayed or undelivered message

You retain ownership of the data and content you submit ("Your Content"). You grant us a limited license to host, process, transmit, and display Your Content solely to provide and improve the Service. You represent that you have all rights and consents needed for Your Content, including consents from the individuals whose data you upload.

The Service, including its software, design, and branding, is owned by iCare4Pune and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes. No other rights are granted.

Certain features may require payment. Fees, billing terms, and renewal conditions are presented at the point of purchase or in a separate order. Fees are non-refundable except as required by law or stated otherwise. We may change pricing with reasonable advance notice.

The Service may integrate with or link to third-party services (e.g., carriers, payment processors, lenders). We are not responsible for third-party services, their content, or their practices; your use of them is governed by their own terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT ANY COMMUNICATION WILL BE DELIVERED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ICARE4PUNE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

You will indemnify and hold harmless iCare4Pune from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your communications, your violation of these Terms, or your violation of any law or third-party right.

You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, legal risk, or inactivity. Upon termination, your right to use the Service ends; provisions that by their nature should survive (e.g., disclaimers, limitations of liability, indemnification) survive.

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in New York, and the parties consent to their jurisdiction.

We may update these Terms from time to time. We will post the revised Terms with an updated "Last updated" date and provide notice of material changes where required. Continued use of the Service after changes take effect constitutes acceptance.
